IF THE VEHICLE IS ACCEPTED TO OR DISPLAYED AT THE FUTURE COLLECTOR CAR SHOW OR EVENT, OWNER/BUILDER AGREE TO THE FOLLOWING TERMS AND CONDITIONS:
1. Barrett-Jackson shall have the final authority to determine location and display of the vehicle and sole control over all aspects and rules of the competition or event. Once the vehicle is displayed at the event or competition, the vehicle shall not be removed or moved by Owner until the event or show has concluded. No promotion or advertising is allowed unless approved in advance by Barrett-Jackson.
2. Proof of valid auto insurance is required during check in. All fees are non-refundable.
3. Please visit Barrett-Jackson.com and click on “Privacy Policy” for information on how Barrett-Jackson collects and uses your information and the information on the application. By submitting this application, you agree to Barrett-Jackson’s privacy policy.
4. To the fullest extent permitted by law, Owner shall defend, indemnify, and hold harmless Barrett-Jackson and each of its members, affiliated entities, managers, parents, employees, officers and directors, from and against any and all liability, actions, causes of action, harm, lawsuits, allegations, damages, claims, fees or costs (including Barrett-Jackson’s attorneys’ fees and costs) that are asserted against or incurred by Barrett-Jackson arising out of or related to your participation in the competition, event, and/or your vehicle, in each case whether or not caused by the negligence of Barrett-Jackson and whether or not the claims have merit.
5. You hereby assume full responsibility for any risk of bodily injury, death or property or vehicle damage or harm arising out of or related to the competition or event or your participation in the competition or event.
6. For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, you irreversibly agree and consent that Barrett-Jackson, or its affiliated entities, licensees or service providers, may record, film, tape and photograph you, the vehicle, and record your voice, conversation and sounds, or otherwise during and in connection with your appearance during the competition or elsewhere, and that Barrett- Jackson shall be the exclusive owner of the results and proceeds of such taping, photography, footage, content and recording, with the right, throughout the world, an unlimited number of times in perpetuity, to copyright, to use, exploit, broadcast, stream, copy, reproduce, distribute and to license others to use all or any portion thereof, or of a reproduction thereof in connection with any content, video or program or otherwise in any and all media, whether now known or hereafter devised. Your further agree that Barrett-Jackson may use and license others to use your name, voice, image, and likeness in any and all media now known or hereafter devised in the promotion, advertising, sale, publicizing and exploitation of any program, content, promotions, digital content, videos or otherwise, and ancillary products. You agree waive any right of inspection or approval of your appearance or the uses to which such appearance may be put.
7. Arizona law shall govern this agreement. Any dispute, proceeding or controversy relating to or arising out of this application or agreement or the competition shall be brought and adjudicated exclusively in the courts located in Maricopa County, Arizona, and no other court.
8. Barrett-Jackson may, in its sole discretion, cancel or postpone the competition due to fire, a pandemic, virus or disease, flood, governmental order or guidelines, act of GOD or some other unforeseen circumstance. Should Barrett-Jackson cancel or postpone the competition under this provision, no refunds or credits will be provided.
9. Owner acknowledges and grants permission for Barrett-Jackson, its employees or agents to drive or move the vehicle from time to time.
10. Any photographs, videos or content of the vehicle submitted by or on behalf of Owner shall become the property of Barrett-Jackson, and Owner represents and warrants that he has the authority to grant such rights and that Barrett-Jackson’s use of such photographs, videos or content will not infringe the rights of any third parties. Owner grants Barrett-Jackson the irrevocable right to use and reproduce said photographs, videos or content for any purpose in any media. Barrett-Jackson may take video, content, photographs or create other likenesses of the vehicle, and such depictions or content and all rights thereto shall be the sole property of Barrett-Jackson.
